You are agreeing to be bounded by the following “Terms of Service” by creating eprofile.biz Smart Digital Business Card. If you have signing on behalf of your employer, your employer is the Owner responsible for your Account.
ACCOUNT USAGE
While registering as a Smart Digital Business Card to utilize eprofile.biz service you agree to provide your full legal name, current address, phone number, a valid email address, and any other information indicated as required are correct and eprofile.biz may reject your application for an Account, or cancel an existing Account, for any reason, in our sole discretion
COMMUNICATION
You acknowledge that eprofile.biz can use the Primary email address given during registration as the email for communication and will need to be authenticated if they come from other email address.
CREDIENTALS
eprofile.biz is not liable for any loss or damage from your failure of maintaining the security of your Smart Digital Business Card Primary & User Accounts and passwords. You acknowledge that you are responsible for the creation and operation of your Users Account & eprofile.biz is not responsible for any damage cause.
BUYERS CREDIENTALS
You acknowledge that any contract/transactions or sale through your eprofile.biz services is directly between you and your Buyers & we are not responsible, since eprofile.biz is not a market place but a platform providing a solution to streamline the process between you and your validated Buyers
CONTENT
You acknowledge all images, videos, written content, or all Materials & Contents uploaded in your Smart Digital Business Card account is your own sole property and eprofile.biz is not responsible for any copy wright issue & can terminate and penalise you if found guilty.
LEGAL NAME
You acknowledge that you are responsible & ensuring that the legal name of your company is correct and approve by the Government.
STAFF ACCOUNTS
You acknowledge that you are responsible and liable for the acts, omissions and defaults arising from use of Staff Accounts in the performance of obligations under these Terms of Service The Smart Digital Business Card and the users under Staff Accounts are each referred as your Company employers and eprofile.biz is not responsible for any of their acts.
Hyperlinking to our Content
The following organizations may link to our Website without prior written approval:
1. Government agencies; 2. Search engines; 3. News organizations; 4. Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and 5. System wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.
These organizations may link to our home page, to publications or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party’s site.
We may consider and approve other link requests from the following types of organizations:

Wait 2-3 weeks for a response.
Approved organizations may hyperlink to our Website as follows:

No use of eprofile.biz logo or other artwork will be allowed for linking absent a trademark license agreement.
PAYMENT GATEWAYS
You acknowledge that it is your sole responsibility as a Smart Digital Business Card to activate use the payment gateways. If you do not wish to online payment account it is your responsibility to deactivate them and enable the Bank Transfer or COD options
Limitation of Liability
You expressly understand and agree that, to the extent permitted by applicable laws, eprofile.biz shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Service.
Reservation of Rights
We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.
WARRANTY
Your use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory. eprofile.biz does not warrant that the Services will be uninterrupted, timely, secure, or error-free. eprofile.biz does not warrant that the results that may be obtained from the use of the Services will be accurate or reliable. eprofile.biz is not responsible for any of your tax obligations or liabilities related to the use of eprofile.biz’s Services. eprofile.biz does not warrant that the quality of any products, services, information, or other materials purchased or obtained by you through the Services will meet your expectations, or that any errors in the Services will be corrected. We are not responsible if you break the law, breach this agreement or go against the rights of a third party, especially if you get sued. Service is “as is” so it may have errors or interruptions and we provide no warranties and our liability is limited.
FEE & REFUNDS
SUBSCRIPTION FEE Subscription Fees is paid in advance and will be billed based on the pack chosen & the cost for services will vary from time to time, at eprofile.biz sole discretion. REFUNDS eprofile.biz does not provide refunds.
INTELLECTUAL PROPERTY
We do not claim any intellectual property rights over the Materials you provide to the eprofile.biz Service. All Materials you upload to your eprofile.biz Store remains yours. You can remove your eprofile.biz Store at any time by deleting your Account. PRIVACY & DATA PROTECTION eprofile.biz is firmly committed to protecting the privacy of your personal information and the personal information of your Buyers. By using eprofile.biz Services, you acknowledge and agree that eprofile.biz’s collection, usage and disclosure of this personal information is governed by our Privacy Policy. JUDICIARY You acknowledge you agree all the Terms & Conditions will be governed in all respects by laws of India. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the courts of Pondicherry, INDIA, as applicable, except that in actions seeking to enforce any order or any judgement of such court of INDIA, such personal jurisdiction shall be non-exclusive. The choice of venue shall remain with eprofile.biz.
ADDITIONAL TERMS
TERMINATION eprofile.biz will cease providing you with the Services and you will no longer be able to access your Account; unless otherwise provided in the Terms of Service, you will not be entitled to any refunds of any Fees, pro rata or otherwise; Your Smart Digital Business Card website will be taken offline. THIRD PARTY CONNECTIONS eprofile.biz may from time to time recommend, provide you with access to, or enable third party software applications, but eprofile.biz is not responsible for third party services so use them at your own risk. If you use Third Party Services on the eprofile.biz platform, you permit us to send your data to those services. If you use Third Party Services you agree that we do not provide a warranty, so check with their Terms and Conditions beforehand. ACKNOWLEDGEMENT You agree that you have read and accept all our terms and conditions contained or expressly referenced in these Terms of Service. By using eprofile.biz services, you are agreeing to all the terms & conditions & also aware these terms and conditions will change time to time & you will regularly check the updates.
